Master Platform Agreement

This Master Platform Agreement ("Agreement") governs access to and use of the Assessment.com platform, website, software, tools, and services (collectively, the "Platform").

This Agreement incorporates and includes the following documents:

By accessing or using the Platform, creating an account, purchasing assessments, building assessments, or administering assessments through the Platform, you agree to be legally bound by this Agreement and all incorporated policies.

If you do not agree, you may not access or use the Platform.

1. PLATFORM TERMS AND CONDITIONS

1.1 Eligibility

You must be at least 13 years of age to use the Platform.

If you are under the age of majority in your jurisdiction, you must have the consent of a parent or legal guardian.

Organizations using the Platform represent that they have the legal authority to bind their organization to this Agreement.

1.2 Platform Services

Assessment.com provides a platform for the creation, administration, distribution, and analysis of assessments, surveys, and related tools.

These services include but are not limited to:

  • Online assessments
    • Surveys and questionnaires
    • Personality and career assessments
    • Recruiting and screening tools
    • Marketplace distribution of assessments
    • AI-powered assessment creation tools
    • AI interpretation tools and reporting tools
    • Data analytics and reporting tools
    • The MAPP (Motivational Appraisal of Personal Potential) Assessment

Users may:

  • Take assessments for personal development
    • Administer assessments to others
    • Host and sell assessments, tests, or surveys privately
    • Create and distribute assessments
    • Sell assessments through the marketplace
    • Purchase assessments created by others

Assessment.com reserves the right to approve, reject, remove, or limit distribution of any assessment on the marketplace at its sole discretion.

2. SOFTWARE LICENSE AGREEMENT

2.1 Grant of License

Subject to compliance with this Agreement, Assessment.com grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform.

This license is granted solely for:

  • Personal use
    • Organizational use
    • Educational use
    • Commercial use within the platform ecosystem

The Platform is licensed, not sold.

2.2 Restrictions

You may not:

  • Copy, replicate, or reproduce platform software
    • Reverse engineer scoring algorithms
    • Extract or scrape assessment databases
    • Resell the platform software outside the platform without written permission
    • Create derivative works based on proprietary algorithms
    • Circumvent platform security or usage restrictions

2.3 Intellectual Property

All Platform technology, including:

  • assessment scoring systems
    • psychometric methodologies
    • AI tools
    • algorithms
    • databases
    • reporting frameworks
    • the MAPP assessment

are the exclusive property of Assessment.com or its licensors and are protected under U.S. and international intellectual property laws.

No ownership rights are transferred to users.

3. ASSESSMENT CREATOR & MARKETPLACE AGREEMENT

Users may create and sell assessments through the Assessment.com marketplace.

3.1 Creator Responsibilities

Creators are responsible for:

  • accuracy of their assessments
    • compliance with applicable laws
    • customer support for purchasers
    • refunds and chargebacks
    • compliance with consumer protection laws

Assessment.com does not guarantee marketplace distribution.

Assessments may be sold privately even if not listed publicly.

3.2 Marketplace Revenue Share

Marketplace & Hosted Assessments Revenue Share

Marketplace and hosted assessments revenue is shared between creators and Assessment.com.

Revenue share is calculated based on total creator sales volume on a rolling 30-day basis.

Monthly Sales Creator Share Platform Share
$0 – $999 70% 30%
$1,000 – $4,999 75% 25%
$5,000 – $9,999 80% 20%
$10,000 – $19,999 85% 15%

Payments to creators will be processed after applicable merchant processing and chargeback windows have been satisfied.

Creators remain responsible for customer disputes, refunds, and chargebacks.

3.3 Creator Intellectual Property

Creators retain ownership of the assessments they create.

However, creators grant Assessment.com a worldwide license to host, distribute, display, and sell their assessments through the platform.

Assessment.com may remove assessments that violate platform policies.

4. ENTERPRISE LICENSING TERMS

Organizations including:

  • companies
    • universities
    • schools
    • coaching organizations
    • consulting firms

may purchase enterprise licenses.

Enterprise administrators are responsible for:

  • user management
    • data compliance
    • obtaining consent from participants
    • secure data handling

Enterprise customers may distribute assessments internally or externally.

Enterprise clients agree that Assessment.com is a technology provider and platform host, not the administrator of their data practices.

5. DATA COLLECTION AND PRIVACY POLICY

Assessment.com collects and processes data in accordance with its Privacy Policy, which forms part of this Agreement.

Data collected may include:

  • personal information
    • contact information
    • assessment responses
    • behavioral information
    • demographic information
    • psychometric scoring data

5.1 Inviting Organizations

When you complete an assessment administered by an organization (such as an employer, school, or coach), your information may be shared with that organization.

Once transmitted, the organization becomes an independent controller of your data.

Assessment.com is not responsible for how those organizations use or store your data.

5.2 Payment Processing

Payments are processed by third-party payment processors such as Stripe.

Assessment.com does not store full payment information.

Payment processors maintain their own privacy and security standards.

5.3 Anonymized Data Use

Assessment.com may use anonymized or aggregated data to:

  • improve assessments
    • refine scoring models
    • create comparison groups and norms
    • conduct research
    • improve platform performance
    lease or sell anonymized data to firms for the purpose of artificial intelligence training, machine learning, or AI model improvement

Such anonymized data:

  • does not contain personally identifiable information
    • cannot reasonably identify individuals

Assessment.com may share anonymized data with research partners, analytics providers, technology partners, and artificial intelligence developers.

6. AI TOOLS DISCLAIMER

The Platform may include AI-powered tools, including but not limited to:

  • AI assessment builders
    • AI assistants
    • automated scoring tools
    • automated report generators
    AI generated narratives
    AI career or role matching tools

All AI outputs are provided for informational purposes only.

AI-generated content does not constitute:

  • legal advice
    • medical advice
    • psychological advice
    • career advice
    • financial advice

Users are solely responsible for evaluating and determining how to use any AI generated outputs.

7. MARKETING COMMUNICATIONS

By creating an account you consent to receiving communications including:

  • platform updates
    • product announcements
    • promotional offers
    • surveys and feedback requests
    third-party offers, partner promotions, or related opportunities that may be relevant to assessments, education, coaching, career development, or personal development

Users may unsubscribe from promotional communications at any time.

8. DISCLAIMERS

The Platform is provided "as is" and "as available."

Assessment.com does not guarantee:

  • accuracy of assessment results
    • employment outcomes
    • psychological accuracy of third-party assessments
    • uninterrupted platform availability

Assessment results should not be interpreted as medical or psychological diagnoses.

9. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

Assessment.com shall not be liable for:

  • indirect damages
    • incidental damages
    • consequential damages
    • lost profits
    • lost business opportunities

The maximum liability of Assessment.com shall not exceed the amount YOU paid to Assessment.com in the three (3) months preceding the event giving rise to the claim.

10. THIRD-PARTY SERVICES

The platform integrates with third-party services, APIs, and technologies including but not limited to payment processors, analytics providers, artificial intelligence systems, hosting providers, and other integrations.

Assessment.com does not control and is not responsible for the availability, accuracy, performance, or policies of these third-party services.

11. TERMINATION

Assessment.com may suspend, restrict, or terminate accounts for:

  • violation of this Agreement
    • abuse of the platform
    • fraud or illegal activity
    • harmful conduct toward other users
    • conduct deemed by Assessment.com to create a nuisance or disruption to the platform or its community

Termination may occur with or without prior notice.

12. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Assessment.com and its affiliates from claims arising out of:

  • misuse of the platform
    • violation of this Agreement
    • infringement of third-party rights
    data breaches, hacking, or unauthorized access resulting from your systems, integrations, or use of the platform

13. MODIFICATIONS

Assessment.com may modify this Agreement at any time.

Updated versions will be posted on the Platform.

Continued use of the Platform constitutes acceptance of the revised Agreement.

14. GOVERNING LAW

This Agreement shall be governed by the laws of the State of Florida.

15. Assessment Results and Professional Reliance Disclaimer

The assessments, tests, surveys, questionnaires, reports, and other materials provided through the Assessment.com platform (collectively, “Assessment Results”) are intended solely for informational, educational, and self-development purposes.

Assessment Results are not intended to diagnose psychological conditions, provide medical advice, offer legal advice, or guarantee career, educational, or employment outcomes.

While some assessments may be based on established research, behavioral models, or psychometric methodologies, Assessment.com does not guarantee the scientific validity, predictive accuracy, or suitability of any assessment for any particular purpose.

Users, organizations, and administrators are solely responsible for how they interpret and use Assessment Results.

Assessment Results should not be used as the sole basis for:

  • hiring decisions
    • employment termination decisions
    • admissions decisions
    • promotion decisions
    • medical or psychological evaluations
    • financial or legal decisions

Organizations using the Platform represent and warrant that they will use assessments as one of multiple factors in any decision-making process and that they will comply with all applicable employment, privacy, discrimination, and consumer protection laws.

Assessment.com shall not be liable for any decisions, actions, or outcomes that result from the use or interpretation of Assessment Results.

Users are encouraged to consult qualified professionals where appropriate before making significant personal, educational, or employment decisions.

Assessment.com does not represent that any assessment available on the platform is validated for employment screening, clinical diagnosis, or regulated professional use unless expressly stated in writing by Assessment.com.
