This Assessment Creator & Marketplace Agreement (“Creator Agreement”) governs the participation of creators who develop, host, distribute, or sell assessments through the Assessment.com platform (the “Platform”).

This Agreement forms part of the Assessment.com Master Platform Agreement and incorporates its terms by reference.

By creating, hosting, distributing, or selling assessments on the Platform, you agree to be bound by this Agreement.

1. Definitions

For purposes of this Agreement:

Creator
means any individual or organization that creates, uploads, hosts, distributes, or sells an assessment on the Platform.

Assessment
includes assessments, tests, quizzes, surveys, questionnaires, forms, scoring systems, reports, and related materials.

Marketplace
means the public listing and distribution system on Assessment.com through which users may purchase or access assessments.

Hosted Assessments
means assessments hosted on the platform but distributed privately by the creator.

2. Creator Eligibility

Creators must:

• have a valid Assessment.com account
  • provide accurate identity and payment information
  • comply with all applicable laws and regulations
  • comply with this Agreement and the Master Platform Agreement

Assessment.com reserves the right to approve or reject creators at its sole discretion.

3. Assessment Creation and Distribution

Creators may use the Platform to:

• create assessments
  • host assessments
  • distribute assessments publicly through the Marketplace
  • distribute assessments privately through direct links or invitations
  • sell access to assessments
  • administer assessments to individuals or organizations

Assessment.com reserves the right to approve, decline, remove, or restrict any assessment from the Marketplace or the website at its sole discretion.

Creators may host,sell and distribute assessments privately even if not listed publicly on the marketplace.

4. Marketplace & Hosted Assessments Revenue Share

Marketplace and hosted assessments revenue is shared between the Creator and Assessment.com.

Revenue share is determined by the Creator’s rolling 30-day sales volume.

Revenue calculations are based on gross sales before taxes and merchant fees.

Payment to Creators will occur after applicable merchant processing and chargeback windows have been satisfied.

Creators are responsible for handling disputes, refunds, and customer service related to their assessments.

5. Creator Intellectual Property

Creators retain ownership of the intellectual property associated with assessments they create.

However, by uploading or hosting an assessment on the Platform, the Creator grants Assessment.com a worldwide, non-exclusive, royalty-free license to:

• host the assessment
  • display the assessment
  • distribute the assessment through the Marketplace
  • process the assessment for scoring and reporting
  • promote the assessment within the platform ecosystem

This license remains in effect for as long as the assessment is hosted on the Platform.

6. Creator Responsibilities

Creators are solely responsible for:

• the content and accuracy of their assessments
  • the validity of scoring methodologies
  • ensuring assessments comply with applicable laws
  • customer support related to their assessments
  • refund handling and dispute resolution

Creators represent and warrant that:

• they own or have the legal right to distribute their assessments
  • their assessments do not infringe on third-party rights
  • their assessments do not violate intellectual property laws
  
  

7. Marketplace Standards

Assessments listed publicly in the Marketplace must not contain:

• illegal content
  • discriminatory or unlawful material
  • deceptive or misleading claims
  • copyrighted content without permission
  • malicious code or harmful software

Assessment.com reserves the right to remove any assessment that violates platform standards.

8. Assessment Liability

Creators acknowledge that Assessment.com acts solely as a technology platform and distribution marketplace.

Assessment.com does not:

• review or validate the scientific accuracy of third-party assessments
  • guarantee the effectiveness of any assessment
  • endorse creator assessments listed on the platform

Creators are solely responsible for claims made regarding their assessments.

Creators agree to indemnify Assessment.com against any claims arising from:

• the use of their assessments
  • inaccurate results or interpretations
  • claims made about assessment validity
  
  

9. Scientific Validation and Claims Regarding Assessments

Creators must ensure that all descriptions, marketing materials, and claims related to their assessments are accurate and not misleading.

Creators may not represent or imply that an assessment is:

• scientifically validated
  • psychometrically validated
  • clinically validated
  • professionally certified
  • approved by Assessment.com
  • suitable for regulated professional use

unless such claims are supported by documented evidence and explicitly approved in writing by Assessment.com.

Creators must not make claims that an assessment:

• guarantees career success
  • predicts employment outcomes
  • diagnoses psychological conditions
  • replaces professional advice

Assessment.com does not independently verify or certify the scientific validity of creator assessments listed on the Platform.

Assessments listed on the Marketplace are provided by independent creators and do not necessarily reflect the views or scientific standards of Assessment.com.

Assessment.com reserves the right to:

• request documentation supporting scientific claims
  • modify or remove misleading descriptions
  • remove assessments making unsupported claims

Creators are solely responsible for any representations they make regarding the scientific basis, accuracy, or predictive capabilities of their assessments.

10. Employment and Hiring Compliance Disclaimer

Creators acknowledge that their assessments may be used by organizations for employment-related purposes including recruiting, screening, or workforce development.

Creators agree that:

• Assessment.com does not control how assessments are used by organizations
  • Assessment.com does not guarantee that assessments comply with employment laws or regulations
  • Assessment.com does not validate assessments for use in hiring or employment decisions unless explicitly stated in writing

Creators are responsible for ensuring that any assessments marketed for employment or hiring purposes comply with applicable laws including but not limited to:

• employment discrimination laws
  • equal employment opportunity regulations
  • data privacy laws
  • consumer protection laws

Creators must not claim that their assessments are approved for employment screening, hiring decisions, or regulatory compliance unless such approval is clearly documented and supported by appropriate legal or scientific review.

Organizations using assessments for employment purposes must ensure that assessments are used as one of multiple decision-making factors and not as the sole determinant of employment decisions.

Assessment.com disclaims all liability for employment decisions made using creator assessments.

Creators agree to indemnify and hold harmless Assessment.com from any claims, investigations, or legal actions arising from the use of their assessments in employment or hiring contexts.

11. AI and Platform Tools

Creators may use platform tools including:

• AI assessment builders
  • AI-generated narratives
  • AI matching tools
  • automated scoring systems

Creators remain responsible for reviewing AI-generated content used within their assessments.

Assessment.com makes no guarantee regarding the accuracy or reliability of AI-generated content.

12. Data Use

Creators may collect assessment responses from participants.

Creators are responsible for complying with:

• privacy laws
  • consumer protection laws
  • employment regulations
  • data protection requirements

Assessment.com is not responsible for how creators use participant data once it is shared with them.

13. Payments and Payouts

Creator payouts are processed through third-party payment processors.

Creators must provide valid payment information to receive payouts.

Assessment.com may withhold payouts in cases involving:

• fraud investigations
  • chargebacks
  • disputes or policy violations
  
  

14. Termination

Assessment.com may suspend or terminate a Creator account if:

• the Creator violates platform policies
  • assessments violate laws or platform standards
  • the Creator engages in fraudulent activity
  • the Creator creates nuisance or disruption to the platform

Upon termination:

• assessments may be removed from the Marketplace
  • access to creator tools may be revoked
  
  

15. Indemnification

Creators agree to indemnify and hold harmless Assessment.com from claims arising out of:

• the Creator’s assessments
  • misuse of assessment results
  • violation of intellectual property rights
  • data privacy violations
  • regulatory violations
  
  

16. Limitation of Liability

To the fullest extent permitted by law, Assessment.com shall not be liable for damages arising from:

• the use of creator assessments
  • assessment outcomes or interpretations
  • marketplace transactions

Maximum liability shall not exceed the amount paid to Assessment.com during the three months preceding the claim.

17. Modifications

Assessment.com may modify this Agreement at any time.

Updated versions will be posted on the Platform.

Continued use of the Platform constitutes acceptance of the updated terms.

18. Governing Law

This Agreement shall be governed by the laws of the State of Florida.

By creating or distributing assessments on the Assessment.com platform, you acknowledge that you have read, understood, and agree to be bound by this Assessment Creator & Marketplace Agreement.
