Assessment.com and International Assessment Network LLC. (“Assessment.com,” “we,” “us,” or “our”) provides cloud based assessment, survey, testing, and analytics tools for individuals, educators, businesses, coaches, and government agencies (the “Services”). This Privacy Policy explains how we collect, use, disclose, and safeguard personal information when you visit www.assessment.com or use any of our apps, APIs, or marketplace features (collectively, the “Platform”).
By accessing or using the Platform, you acknowledge that you have read this Privacy Policy and agree to the practices described here. If you do not agree, you should not access or use the Platform.
We collect the following categories of information, depending on how you interact with the Platform:

Children’s Data: The Platform is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided personal information without parental consent, please contact us at info@assessment.com and we will take appropriate steps to delete such information.
We use personal information for the purposes and on the legal bases summarized below (where GDPR-style frameworks apply):

Use of Anonymized Assessment Data
In addition to using your assessment responses and results to provide you with your individual MAPP or other assessment reports, we may also use assessment data in an anonymized or aggregated form for research, product improvement, and norming purposes. Before using data for these purposes, we remove or modify personal identifiers such as your name, email address, account details, and other direct identifiers so that the information can no longer reasonably be linked to you as an individual. Anonymized and aggregated data may be used to analyze trends, improve the accuracy and effectiveness of our assessments, develop new features, create comparison groups and norms, and generate reports or insights that do not identify any specific individual. Because anonymized data is no longer considered personal data under applicable privacy laws, we may retain and use it for these purposes without further notice or compensation to you.
AI Tools and Automated Processing
The Platform may offer access to artificial intelligence and automated tools, including but not limited to AI powered assessment builders, AI assistants, content generators, and automated scoring or interpretation features (collectively, “AI Tools”). When you use AI Tools, we process the information you provide, such as prompts, assessment content, or user data you choose to include, in order to generate outputs requested by you or your organization.
AI generated outputs are produced automatically based on patterns in data and are provided on an “as is” and “as available” basis for informational purposes only. We do not guarantee that any AI generated content will be accurate, complete, or appropriate for any particular use, and such outputs do not constitute legal, medical, psychological, financial, career, or other professional advice. You are solely responsible for reviewing, validating, and deciding whether and how to use any AI generated outputs and for complying with all applicable laws and your own internal policies when you use those outputs with employees, candidates, students, or other individuals.
Where required by law, we do not make solely automated decisions using AI Tools that produce legal or similarly significant effects about you without appropriate safeguards or additional human review. If you have questions about how AI Tools are used in connection with your data, you may contact us using the details in Section 12.
Sharing of Assessment and Survey Results with Inviting Parties
If you access or complete any assessment, test, survey, questionnaire, or similar instrument on or through the Assessment.com Platform using a link, email invitation, access code, or other method provided by a company, school, organization, coach, or individual (collectively, an “Inviting Party”), you understand, accept, and agree that your responses and results may be shared with that Inviting Party and any authorized users acting on its behalf. The Inviting Party may determine which results you can see, how your results are used, and how long they are retained, and may combine your results with information it already holds about you. Any use of your information by an Inviting Party is governed by that party’s own policies and practices, not this Privacy Policy, and we are not responsible for, and disclaim all liability arising from, their use, handling, or disclosure of your information. If you choose not to create or register an account with Assessment.com, you may not be able to view your results, access detailed reports, or maintain a record of assessments you have taken on the Platform, even though the Inviting Party may still have access to your responses and results.
Sharing with Third Parties at Your Direction
We do not sell or rent your personal data to third party marketers. We only share your personal data with third parties when you initiate or clearly direct us to do so. For example, if you register for or request access to a third party assessment, test, questionnaire, survey, quote, estimation, or similar service through our Platform, and the third party requires information such as your name, mailing address, email address, or phone number, you understand and agree that we may disclose that information to that third party in order to fulfill your request. Likewise, when you click a link, button, or call to action that indicates you wish to visit a third party website or receive information or offers from a third party, you are authorizing us to share the information reasonably necessary to complete that action. Any personal data provided to a third party in this way will be handled in accordance with that third party’s own privacy policy and practices, not this Privacy Policy, and we are not responsible for, and disclaim all liability arising from, their use, handling, or security of your information.
Marketing Communications
By creating an account on the Assessment.com Platform, using our Services, or providing your email address to us, you consent to receive emails and other electronic communications from Assessment.com and its affiliates. These communications may include service related messages, account and transactional notices, security alerts, special offers, promotions, and information about products and services that may be relevant to you, such as assessments, coaching, courses, and related career or personal development resources. We may also send you surveys or invitations to provide feedback. You may opt out of receiving promotional emails at any time by using the unsubscribe link included in those communications or, where available, by updating your communication preferences in your account settings. Please note that even if you opt out of promotional or marketing emails, we may still send you non marketing communications that are necessary for the operation of the Platform and your account, such as service announcements, legal or security notices, and transactional messages related to your use of the Services.
Data Availability and Third Party Data Sources
While we take reasonable steps to maintain the availability and integrity of the Assessment.com Platform, you acknowledge and agree that we are not responsible for any loss, deletion, corruption, or failure to store any content, data, assessments, reports, or other materials that you or your users submit to or generate through the Platform. You are solely responsible for maintaining your own backup copies of any data that is important to you. In addition, the Platform may receive or display data, content, or results from third party APIs, integrations, or partners. Such third party data is provided “as is,” and we do not control, guarantee, or warrant its accuracy, completeness, timeliness, or continued availability. Assessment.com and its affiliates will not be liable for any loss, damage, or costs arising out of or related to lost, deleted, inaccessible, corrupted, or inaccurate data, whether originating from the Platform itself or from any third party service or integration.
Third-Party Registrations, Data Sharing, and Communications Consent
Assessment.com operates as a platform that allows organizations, schools, coaches, employers, and other third parties (“Inviting Organizations”) to administer assessments, surveys, tests, or related services to respondents.
When you register, create an account, or complete any assessment, survey, questionnaire, or registration form at the request of an Inviting Organization, you acknowledge and agree that the information you provide including but not limited to your name, contact information, registration responses, and assessment results (“Registration Data”) is being collected on behalf of and will be shared with that Inviting Organization.
Disclosure to Inviting Organizations
By participating in an assessment or registration initiated by an Inviting Organization:
Any questions, requests, opt-outs, or complaints regarding the use of your information by an Inviting Organization must be directed to that organization.
Communications Consent (Email, Calls, and Text Messaging)
By registering on Assessment.com or by completing an assessment, survey, or related registration requested by an Inviting Organization, you expressly consent to receive communications related to that activity. These communications may include emails, telephone calls, or text messages (including automated or prerecorded communications) from Assessment.com and/or the Inviting Organization regarding:

Limitation of Responsibility
To the maximum extent permitted by law, by using Assessment.com you acknowledge and agree that:
By using the platform, you agree to release, indemnify, and hold harmless Assessment.com and its owners, affiliates, and operators from claims, damages, or liabilities arising from the actions, communications, or data practices of any Inviting Organization or third party that receives your information through your participation.
Payment Processing and Financial Data
Assessment.com does not collect or store your full credit card, debit card, or bank account information. All payments to us and payouts from us are processed by third party payment providers such as Stripe or other similar services (“Payment Processors”). When you make a purchase on the Platform or when you receive payments from us (including, without limitation, creator, affiliate, or referral payouts), you will be required to set up or connect your payment or bank details directly with the applicable Payment Processor, which will store and secure that information in accordance with its own privacy and security practices. We only receive limited information from the Payment Processors that is necessary to confirm payment status, manage your account, and comply with applicable law, and we are not in possession of, and are not responsible or liable for, any bank account, card, or other financial information you provide to the Payment Processors.
We use cookies and similar technologies to help the Platform function and to understand how it is used.

Once results are delivered to an assessment sponsor or Inviting Party, we do not control how they use or retain that information. Their own privacy notices and agreements will govern their use of your data.
Our servers are located in the United States. If you access the Platform from outside the U.S., you understand and agree that your information may be transferred to, stored in, and processed in the United States, which may have different privacy rules than your country. Where required for transfers from the EEA, UK, or similar jurisdictions, we rely on appropriate safeguards such as the European Commission’s standard contractual clauses or equivalent mechanisms.
We retain personal data for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, unless a longer period is required or permitted by law. In general:

These timeframes are general guidelines. We may retain certain data longer where necessary to comply with legal obligations, resolve disputes, enforce our agreements, or protect our rights, as permitted by applicable law. You may request earlier deletion of personally identifiable Assessment Data as described in Section 9.
We take reasonable and appropriate technical and organizational measures to help protect your personal data from accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or access. These measures may include encryption in transit, access controls, logging, regular security updates, and internal policies designed to limit access to personal data to those employees, contractors, and service providers who need it to perform their work and who are bound by confidentiality obligations.
However, no website, online service, or data transmission can be guaranteed to be 100 percent secure. You acknowledge that you provide your information at your own risk and that we cannot guarantee the absolute security of your personal data. You are responsible for maintaining the confidentiality of your account credentials and for restricting access to your devices, and you agree to notify us promptly if you believe your account or any of your credentials have been compromised.
If we become aware of a data incident that affects the security of your personal data, we will take appropriate steps consistent with applicable laws, which may include investigating the incident, taking reasonable measures to mitigate any harm, and notifying you and/or relevant authorities where required.

If you are located in the European Economic Area (EEA), the United Kingdom (UK), or another region that provides similar data protection rights, Assessment.com acts as a “controller” of your personal data when we determine the purposes and means of processing, and as a “processor” when we process personal data on behalf of an assessment sponsor or Inviting Party.

Where we process personal data on behalf of an assessment sponsor or Inviting Party, we may need to refer your request to that party so that they can respond directly in their capacity as controller.
Additional Information for California Residents
If you are a resident of California, you may have additional rights under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), with respect to personal information about you.
Categories of Personal Information: In the preceding 12 months, we have collected the categories of personal information described in Section 2 (such as identifiers, internet activity, and professional information) from the sources and for the business and commercial purposes described in Sections 2 and 3. We may disclose these categories of personal information to the categories of recipients described in Section 5 for the purposes described there.
No Sale or Sharing for Cross Context Behavioral Advertising: We do not “sell” or “share” personal information about you as those terms are defined under the CCPA/CPRA. If this changes in the future, we will update this Privacy Policy and provide you with any required notices and choices.

We will respond within the time period required by applicable law (typically 30 to 45 days) and may retain certain data where required by law, to defend legal claims, or as otherwise permitted by applicable law.
The Platform may contain links to third party websites, apps, or services. We are not responsible for the privacy practices or content of those third parties. We encourage you to review the privacy policies of any third party site or service before providing personal information.
We may update this Privacy Policy from time to time. The “Effective Date” at the top indicates the date of the latest revision. If we make material changes, we will provide notice through the Platform, by email, or by other reasonable means. Your continued use of the Platform after any such changes become effective constitutes your acceptance of the revised Privacy Policy.
