Assessment.com Enterprise Licensing Terms

These Enterprise Licensing Terms (“Enterprise Terms”) govern the use of the Assessment.com platform by organizations purchasing enterprise access to the platform (“Enterprise Customer”).

These Enterprise Terms form part of the Assessment.com Master Platform Agreement and incorporate its terms by reference.

By purchasing or using an enterprise license, the Enterprise Customer agrees to be bound by these terms.

  1. Enterprise License Grant

Subject to compliance with the Master Platform Agreement and these Enterprise Terms, Assessment.com grants the Enterprise Customer a limited, non-exclusive, non-transferable, revocable license to access and use the Assessment.com platform for internal business or organizational purposes.

The Enterprise License allows the Enterprise Customer to:

  • administer assessments to employees, students, clients, or participants
    • distribute assessments through links, invitations, or access codes
    • access reporting and analytics tools
    • manage users and administrators
    • utilize platform AI tools and reporting features
    • host private assessments within the organization

The license is granted solely for the Enterprise Customer’s internal use unless otherwise agreed in writing.

  1. Enterprise Administrators

Enterprise Customers may designate administrators who are responsible for:

  • managing user accounts
    • assigning assessments
    • accessing participant results
    • configuring enterprise settings
    • ensuring compliance with platform policies

Administrators are responsible for all activity conducted through the enterprise account.

  1. Participant Data and Responsibilities

Enterprise Customers may administer assessments to participants including:

  • employees
    • job applicants
    • students
    • coaching clients
    • program participants

The Enterprise Customer is responsible for:

  • obtaining appropriate consent from participants
    • complying with applicable privacy and employment laws
    • informing participants how their data will be used
    • ensuring lawful processing of participant data

Assessment.com acts as a technology platform provider and processor of data, but the Enterprise Customer remains responsible for its use of assessment results.

  1. Access to Assessment Results

Enterprise administrators may have access to participant responses, scores, and reports generated through the platform.

Enterprise Customers acknowledge that:

  • they determine how assessment results are used internally
    • they are responsible for interpreting assessment results appropriately
    • they must comply with applicable laws when using results for employment or educational purposes

Assessment.com is not responsible for decisions made by Enterprise Customers based on assessment results.

  1. AI Tools and Automated Features

The platform may include artificial intelligence tools including:

  • AI-generated narratives
    • AI role or career matching
    • automated scoring models
    • AI assistants

AI outputs are provided for informational purposes only.

Enterprise Customers are responsible for reviewing and validating any AI-generated content before relying on it.

AI outputs should not be used as the sole basis for:

  • hiring decisions
    • admissions decisions
    • disciplinary decisions
    • psychological evaluations

  1. Fees and Payment

Enterprise Customers agree to pay all applicable fees associated with their enterprise license.

Enterprise pricing may include:

  • subscription fees, MAPP Keycode Fees
    • per-assessment and/ or ai usage fees
    • enterprise seat licenses
    • custom enterprise agreements

Fees are non-refundable unless otherwise stated in a written agreement.

Failure to pay required fees may result in suspension of enterprise access.

  1. Data Security

Assessment.com implements commercially reasonable technical and organizational measures to protect platform data.

However, Enterprise Customers acknowledge that:

  • no system can guarantee absolute security
    • the Enterprise Customer is responsible for the security of its own systems
    • unauthorized access resulting from the Enterprise Customer’s internal systems is not the responsibility of Assessment.com

Enterprise Customers must notify Assessment.com promptly of any known data breaches involving platform data.

  1. Data Ownership

Enterprise Customers retain ownership of data they collect through the platform, including participant responses.

However, Assessment.com retains ownership of:

  • the platform technology
    • scoring systems and algorithms
    • AI tools
    • reporting frameworks
    • anonymized and aggregated platform data

Assessment.com may use anonymized or aggregated data to:

  • improve platform functionality
    • refine scoring models
    • develop comparison norms
    • train artificial intelligence systems

Such anonymized data will not contain personally identifiable information.

  1. Compliance with Employment Laws

Enterprise Customers using the platform for employment purposes agree that:

  • assessments will not be the sole factor in hiring or employment decisions
    • assessments will be used in compliance with applicable employment laws
    • the Enterprise Customer is responsible for ensuring lawful use of assessments

Assessment.com does not represent that any assessment is validated for employment screening unless expressly stated.

  1. Third-Party Integrations

The platform integrates with third-party services including:

  • payment processors
    • artificial intelligence providers
    • analytics tools
    • hosting providers

Assessment.com is not responsible for the performance or policies of third-party services.

  1. Term and Termination

Enterprise licenses remain active for the term specified in the enterprise agreement.

Assessment.com may suspend or terminate enterprise access if:

  • the Enterprise Customer violates platform policies
    • required payments are not made
    • the platform is used in unlawful or harmful ways
    • the Enterprise Customer creates nuisance or disruption to the platform

Upon termination:

  • platform access may be revoked
    • enterprise accounts may be disabled

  1. Indemnification

Enterprise Customers agree to indemnify and hold harmless Assessment.com from claims arising out of:

  • misuse of assessments
    • employment decisions based on assessment results
    • failure to obtain participant consent
    • violations of privacy laws
    • data breaches originating from the Enterprise Customer’s systems

  1. Limitation of Liability

To the fullest extent permitted by law, Assessment.com shall not be liable for:

  • indirect damages
    • incidental damages
    • consequential damages
    • lost profits or lost business opportunities

Maximum liability shall not exceed the amount paid by the Enterprise Customer during the three months preceding the claim.

  1. Modifications

Assessment.com may modify these Enterprise Terms from time to time.

Updated versions will be posted on the platform.

Continued use of the platform constitutes acceptance of the updated terms.

  1. Governing Law

These Enterprise Licensing Terms shall be governed by the laws of the State of Florida.

By purchasing or using an enterprise license to the Assessment.com platform, the Enterprise Customer acknowledges that it has read, understood, and agrees to be bound by these Enterprise Licensing Terms.
